Instructors

What is Traina

Traina is an introductory platform between exercisers and independent third party health and fitness suppliers.

By creating an Instructor user account on the Traina website, you are agreeing to these Terms and Conditions as well as our Privacy Policy & Cookies Policy. Please read these Terms and Conditions carefully before submitting your profile for approval and confirming your account. These terms set out the contract between you and us (Traina Ltd).

Please note If you are an instructor who will be setting up their own private studio or classes, you must also agree to the studio terms and conditions.

How we Operate

Traina introduces exercisers (?Users?) to third party health and fitness suppliers (?Providers?), and allows users to purchase spaces in fitness classes, events, workshops, retreats and private 121 sessions (?Experiences?).

Traina is not party to any contract between users and Providers for the provision of their experience, and will not be liable to users or providers in relation to that contract. In the event the user is dissatisfied with the experience in any way, their remedy is only against the Provider.

Your Account

If you would like to remove your profile from www.traina.co.uk at any time during your partnership with Traina, we ask you to let us know in writing at info@traina.co.uk. There may be a 1 month notice period for your profile to be removed unless otherwise agreed.

Your User Content

Our website allows you to use and publish your own text, imagery and video content (?instructor content?). You are solely responsible for your own instructor content and the consequences of publishing it.

On submitting your instructor content for approval you warrant that you own, or have the required rights and permissions to use it, and for Traina as the publisher, to host it at www.traina.co.uk.

By submitting any instructor content for publishing, you also acknowledge that you are granting Traina the permission and license to use any of your instructor content, or derivatives of it, across any of Traina?s owned social media channels, emails or any other customer communication and marketing or business purposes, on behalf of you and your studio partners.

You agree to not use information or material that is false, misleading, unlawful, copyrighted to third parties that you do not have the rights to publish, offensive, obscene, threatening, pornographic, criminal or content which encourages or promotes criminals behaviour.

If any instructor breaches any of the terms above, Traina reserves the right to permanently remove the instructor?s account and may result in the instructor becoming liable to legal action.

Traina does not endorse any user content, opinion, recommendation or advice used within a instructor?s profile. We do not accept any liability in connection to any instructor?s content.

We reserve the right to remove your profile, any of your content and withhold any commission that may be owed to you until any usage rights issues are resolved.

Your Profile Information

When creating your instructor profile and teaching timetable structure, you agree to the following:

Giving only the correct information for your classes. This includes: class name, class type, studio, location, price structure, frequency, time and date.

Not to post classes that do not exist, or any incorrect information about a class. If a client is mis-sold a class based on the information you have given, we reserve the right to remove your instructor profile from Traina and withhold any commission you are owed.

Traina reserves the right to remove any profile, or information within a profile from the site at any time, for any reason, without prior notice.

Service Level Agreement

Instructors agree that changes within their teaching timetable will be amended in their Traina profile, and emailed to info@traina.co.uk as soon as possible, but a minimum of 24 hours before the class, event, workshop, retreat or private 121 session is due to begin. If any class is booked under false information, and the customer complains, Traina reserves the right to remove or suspend the instructor?s profile without warning and charge the instructor for any losses on spaces booked within that class if Traina determines the instructor is at fault.

Payments

When an experience is purchased Traina will take payment from the user on behalf of the provider. The booking for the experience will then be made as a separate transaction from Traina to the provider using all the relevant user details.

If the experience provider does not have an online booking facility for the transaction between Traina and the provider to take place,one batch payment will be made at the end of each week to reconcile all payments owed from the previous week, minus commission. The instructor is responsible for providing the correct bank details in order for accounts to be reconciled, any loss of money due to incorrect details given to Traina is the responsibility of the instructor. Traina does not owe any losses.

The instructor agrees to take responsibility to declare their earnings from Traina and agrees to pay the relevant taxes.

Commercial Terms

There are no charges to feature a profile on the Traina website. For all experience bookings that are purchased via the Traina website, the provider agrees to pay Traina a 20% commission on the cost of the booking. The provider is the owner of the experience and the entity that gets paid for providing an experience (this can be an instructor or a facility).

Traina reserves the right to suspend any account and put all payments on hold when a dispute is in process.

Cancellations and refunds

As the contract is formed between the user and the provider, Traina?s refund policy will reflect that of the provider?s.

In the absence of a provider?s cancellation and refund policy, Traina will allow users to cancel fitness classes 24 hours before the class start time for a full refund. Private 121 sessions within 2 days of the start of the appointment for a full refund. Workshops, events and retreats are non refundable. If users cancel their purchase outside of these timings, the instructor will not be liable for a refund.

If users do not show up to their purchased experience, they will still be charged and the provider will still be paid for that booking.

For any refunds due, Traina will issue an invoice at the end of each week to the provider if full payment has already been made.

If a provider needs to cancel an experience at no fault of the user, a full refund will be required from the provider to Traina within 7 days and Traina will refund the user. All cancellations must be made to info@traina.co.uk as well as on the Studio and associated instructor?s profile page on the Traina website.

Data

We do not pass on our customer data to instructor?s for marketing purposes, but we agree to market and promote your classes (and other experiences), on your behalf, if customers have agreed to receive marketing from Traina.

Future Changes to Terms and Conditions

If we make any changes to the instructor terms and conditions we will let you know via email at least one month prior to the changes taking place.

Please note, If you are setting up your own studio and classes as an instructor, you must agree to the following terms and conditions.

Your Account

By signing up for a Traina profile, you agree that you allow your instructors to promote your studio and your classes on your behalf through their Traina Instructor profile.

Your User Content

We reserve the right to remove your profile, any of your content and withhold any commission owed to you from any bookings through the traina system until any usage rights issues are resolved.

Your Profile Information

When creating your studio profile and class prices, you agree to the following:

Giving only the correct class duration and pricing information for your studio and allocating the quantity of spaces in that class you are happy for Traina to sell on your behalf.

Giving the same pricing information that is available to purchase from your own website.

Giving the correct studio location information.

If a client is mis-sold a class based on the information you have given, we reserve the right to remove your studio profile, from Traina and withhold any commission you are owed.

Traina reserves the right to remove any profile, or information within a profile from the site at any time, for any reason, without prior notice.

Service Level Agreements

Studios agree that changes within their class pricing is reflected in their Traina profile within 24 hours of the change being made on their own website.

If any class is booked under false information given by the studio, and the customer complains,

Exercisers

What is Traina

Traina allows users to search and book spaces in fitness classes, events, workshops, retreats and private 121 sessions (?Experiences?).

By creating a user account and booking an experience via the Traina website, you are agreeing to these Terms and Conditions as well as our Privacy Policy & Cookies Policy. Please read these Terms and Conditions carefully before making any transactions through Traina. These terms set out the contract between you and us (Traina Ltd).

How we Operate

All of the experiences we offer via the Traina website are provided by independent third party health and fitness suppliers and personnel (?Providers?). Whilst Traina is the introductory platform between you and these Providers, you should be aware that we are not party to any contract between you and the Provider for the provision of your experience, and will not be liable to you in relation to that contract. In the event you are dissatisfied with the experience in any way, your remedy is only against the Provider. You are, however, welcome to provide us with your feedback in relation to any experience you may book through our website by emailing us at info@traina.co.uk.

Whilst we have made all reasonable efforts to ensure that we provide experiences from suitable and professional operators and that they use accurate imagery and descriptions of the experiences they provide, we are not able to guarantee the accuracy or suitability of any particular experience offered through the Website.

Our Experiences

The timing and space available for our experiences will vary and depend on availability at time of purchase, therefore we are unable to guarantee availability. We accept orders for our experiences on behalf of independent third party fitness studios and instructors (?Providers?). Traina does not operate any of the experiences we promote or sell. Our experiences are purchased by you from the provider and Traina is acting as the agency. The contract for the order is between you and the provider. Traina is not part to that contract and acts only as an intermediary between you and the provider.

All experiences listed on the website are subject to availability, which can change. Whilst we take every precaution to list only available experiences, sometimes we may not be able to offer experiences that are listed. In this instance, we will attempt to remedy the situation by offering an alternative, or a refund. We reserve the right to amend the details and specifications of our experiences as necessary, and to remove or add new experiences without prior warning.

Please note that you will be bound by the Terms and Conditions of the relevant provider in relation to the experience you have chosen, so you should check with the provider to ensure that your experience meets your requirements and that you fulfil any conditions which may be required for participation in your experience (such as health or age). If you do not check these conditions and you do not meet the requirements of the provider, you may not be eligible to receive a refund.

How is the Contract Between us Formed

You may place an order for an experience advertised on the Traina website. Once you have placed the order and made your payment, a binding contract is formed between you and the provider. After you have placed an order, you will receive a confirmation e-mail from us acknowledging that we have received your order and it has been accepted.

Our Third Party Providers

Whilst we make every effort to ensure that the information displayed on our website is accurate and up to date, we do not guarantee the accuracy, reliability or availability of the information or services given by our providers. If you inform us of any inaccuracies about our experiences, we will attempt to correct them as soon as we reasonably can. Traina is not responsible for your health and safety at any time.

User Content

You understand that when using the Website, you will be exposed to user content from a variety of sources, and that we are not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such user content . You may be exposed to user content that is inaccurate, offensive, indecent, or objectionable, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you may have against us with respect thereto, and agree to indemnify and hold us, our owners, affiliates, employees, agents and/or licensors, harmless to the fullest extent allowed by law regarding all matters related to your use of the Website.

We do not endorse any user content or any opinion, recommendation, or advice expressed therein, and we expressly disclaim any and all liability in connection with user content .

Payments

When you purchase an experience, you are entering into a contract with the provider you have chosen and Traina will take payment from you on behalf of the provider. At the point of purchase, you will be charged 100% of the amount shown.

We accept a variety of payment credit cards. Your credit or debit card payment is processed by our third party payments processor Stripe. Our payments processor is responsible for processing payments or credits in connection with your use of our experiences and for any Personal Information that it collects from you. Please read their terms and conditions and privacy policy as well as those of your credit card issuer. We are not responsible for any errors by the payments processor and we do not store credit card information or any other financial information. To find out more about how Stripe stores and uses your Personal Information, please read their Privacy Policy.

Cancellations and refunds

As your contract is formed between you and the provider, our refund policy will reflect that of the provider?s. Please check the providers terms and conditions for their cancellation and refund policy.

In the absence of a provider?s cancellation and refund policy, Traina will allow you to cancel fitness classes 24 hours before the class start time for a full refund and private 121 sessions within 2 days of the start of the appointment for a full refund. Workshops, events and retreats are non refundable. If you cancel your purchase outside of these timings, you will not receive a refund.

If you do not show up to your purchased experience, you will still be charged. All cancellations must be carried out by emailing info@traina.co.uk

We reserve the right to cancel any purchase order if, for example: your payment is not authorised by our payment system, there is an error on the Website regarding the price or description or if the experience you have purchased is no longer available.

Restrictions

You must be 16 years or over to buy an experience on our website. Please note that certain providers may require a minimum age of 18 years of age. Please check the provider?s website before you make a purchase.

Our responsibilities

If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it was an obvious consequence of our breach or if it was contemplated by you and us at the time we entered into the Contract.

We cannot accept any liability for the actions of our providers or any breach by them of their terms and conditions of sale which apply to a sale of experiences by them to you.

Experiences are sold to you on the basis that you are a consumer. You agree not to use your purchased experiences for any commercial, business or re-sale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

We do not in any way exclude or limit our liability for: death or personal injury caused by our negligence, fraud or fraudulent misrepresentation.

Your Account

You may browse through our Services without creating an account. When you want to purchase an experience , you will need to create an account by providing information including your email address, a password and contact details.

You cannot create an account on behalf of anyone else without their permission. We reserve the right to delete your account at any time, without prior warning and we are under no obligation to reinstate it.

You can stop using our Services at any time. You just have to tell us to delete your account by sending an email to this address info@traina.co.uk

Matters Beyond our Control

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by an Event Outside Our Control. An Event Outside Our Control is defined below in clause below.

An Event Outside Our Control means any act or event beyond our reasonable control, including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.

If an Event Outside Our Control takes place that affects the performance of our obligations under a Contract: we will contact you as soon as reasonably possible to notify you; and our obligations under a Contract will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control.

Changes to our terms and conditions

From time to time we may update our Terms and conditions, if we do we will update you either by posting a notification in your account area, on our website or contact you via email.
